A private, non-profit organization that uses lobbying, litigation and public education to promote civil liberties and civil rights in the state. Provides free legal representation for civil liberties cases. The case must represent a significant civil liberties issue and affect a large number of people. Civil liberties they seek to protect are: Freedom of Expression, Religion, Equality Under the Law, Due Process (the right to be treated fairly when facing criminal charges or other serious accusations) and the Right to Privacy.

Discrimination - Roanoke, Fair Housing Board, City of Roanoke Government Services

The Fair Housing Act covers most housing transactions including rentals, home sales, advertising, mortgage lending, home improvements, and zoning activities, but only if one is discriminated on the basis of one of the following protected classes as defined by federal, state, and /or local law, as follows: race, national origin, color, religion, sex, familial status, and disability. The Commonwealth of Virginia law adds elderliness, and the City of Roanoke law adds age and marital status. Landlord - Tenant issues can also be referred through this service.

Advocacy - Richmond, Help America Vote Act, disAbility Law Center of Virginia

Congress passed the Help America Vote Act of 2002 to improve the administration of elections in the United States. States are provided funding to replace outdated voting systems and are to create minimum standards to follow in key areas of election administration. Among other things, these key areas include voting systems, voting accessibility, statewide computerized voter registration lists, provisional voting, voter education, and voter registration by mail. dLCV monitors the way the Act is carried out with regard to persons with disabilities. dLCV surveys polling sites across the state to make sure they are accessible for persons with visual, sensory, and mobility impairments; provides voting rights information to persons with disabilities; provides voter registration materials to the public; and provides technical assistance, legal advocacy, and legal representation to persons who have been discriminated against in the voting process.

Discrimination Assistance - Richmond, Division of Human Rights, Virginia Office of the Attorney General

Receives and investigates complaints alleging unlawful discrimination that violates state and federal civil rights laws. The complaint process is twofold. First, the DHR investigates complaints alleging discrimination in employment, places of public accommodation, and education institutions in violation of the Virginia Human Rights Act or corresponding federal laws. The DHR will also provide mediation services throughout the complaint process to all the parties to resolve the dispute themselves. If we do not have subject matter jurisdiction over the allegations set forth in a complaint, we will, whenever possible, refer that complaint to the appropriate state or federal agency with jurisdiction. At the conclusion of an investigation, the DHR is charged with determining whether there is reasonable cause to believe discrimination occurred. Safeguards individuals within the Commonwealth from unlawful discrimination because of race, color, religion, national origin, sex, pregnancy, childbirth or related medical conditions, age, marital status or disability.

Housing Discrimination - District of Columbia, Fair Housing, US Department of Justice

The Fair Housing Act also provides procedures for handling individual complaints of discrimination. Individuals who believe that they have been victims of an illegal housing practice, may file a complaint with the Department of Housing and Urban Development [HUD] or file their own lawsuit in federal or state court. The Department of Justice brings suits on behalf of individuals based on referrals from HUD.

Vocational Rehabilitation - Richmond, PABSS, disAbility Law Center of Virginia

Funded by the Ticket to Work and Work Incentives Improvement Act of 1999, the Protection and Advocacy for Beneficiaries of Social Security Program is funded by the Social Security Administration. The Ticket to Work system provides eligible SSI and SSDI beneficiaries with a "ticket" that they can use to obtain vocational rehabilitation (VR), employment services, and other support services from an Employment Network (EN) of their choice. dLCV advocates for Social Security beneficiaries to break down barriers to employment under the PABSS program.

Advocacy - Richmond, PAIR, disAbility Law Center of Virginia

The Protection and Advocacy of Individual Rights Program allows dLCV to expand its services to individuals with disabilities in the community who are not eligible for other advocacy programs. An individual with a disability who requires information or services to overcome discrimination, barriers to living independently, or barriers to accessing benefits and services may be eligible for dLCV assistance under the PAIR Program. Additionally, individuals who need access to goods or services provided by private businesses may be eligible for legal advocacy or representation by dLCV. Individuals may be eligible for services under the PAIR Program only if they are not eligible for DD or PAIMI and are not receiving services under CAP.
